Oregon rent withholding: no right to stop paying, but counterclaims and court-held rent

The Oregon Residential Landlord and Tenant Act, ORS chapter 90, gives tenants remedies for a landlord's noncompliance, but the sections read here do not give a general right to withhold rent. They give a notice and termination path, a deduction for essential services, and a counterclaim in a rent case where the court may order rent paid into court.

What can an Oregon tenant do about a material breach?

ORS 90.360(1) lets a tenant deliver written notice that specifies the breach and says the rental agreement will end on a date at least 30 days after delivery if the breach is not remedied, within 7 days for an essential service or 30 days in all other cases. If you adequately remedy the breach before the date in the notice, the agreement does not end. If substantially the same breach recurs within six months, the tenant may end the agreement on 14 days' written notice. The tenant can also recover damages and seek injunctive relief.

What does ORS 90.365 allow for essential services?

When you intentionally or negligently fail to supply an essential service, the tenant may give written notice that says the tenant may seek substitute services, diminution damages or substitute housing. After you have had a reasonable time and reasonable access, the tenant may take one of three paths.

OptionEffect
Procure the serviceBuy reasonable amounts and deduct the actual and reasonable cost from rent
Recover diminution damagesDamages based on the lower fair rental value of the unit
Substitute housingIf the unit is unsafe or unfit, the tenant is excused from rent for that period and may recover the cost of comparable housing above the rent

For a lack that poses an imminent and serious threat to health, safety or property, the tenant may give notice that the agreement ends in not less than 48 hours unless you fix it. Choosing this section bars the 90.360(1) path for the same breach.

How does the rent-into-court rule work?

ORS 90.370 is the closest Oregon comes to escrow. In an action for possession based on nonpayment, or an action for rent against a tenant in possession, the tenant may counterclaim for any amount allowed under the lease or the chapter. The tenant must prove that before your action was filed you knew, or should have known, or had actual notice of the facts behind the counterclaim.

If the tenant counterclaims, the court at either party's request may order the tenant to pay all or part of the accrued and later rent into court, then decide who is owed what. The net amount owed to one side is paid first from the court money, and the other side pays the balance. A tenant who fails to comply with an order to pay into court is not permitted to assert the counterclaim in the possession action.

Example a made-up Portland landlord sues for $1,800 in unpaid rent. The tenant counterclaims $700 for a 20-day heat outage and the court orders the full $1,800 paid in. If the court finds $700 owed to the tenant, the tenant gets $700 back from the money in court and the landlord gets $1,100.

What happens with attorney fees?

Subsection (4) addresses a tenant who wins less on counterclaims than the rent found due and stays only because rent was paid into court. That tenant is not awarded attorney fees unless the tenant paid at least the balance due to you into court by the start of trial.

What should an Oregon landlord do about a tenant who stops paying?

  • Do not treat a repair complaint as permission to ignore the rent notice process; keep both tracks separate and dated.
  • Answer repair notices in writing before the 7-day and 30-day periods in ORS 90.360 run out.
  • If a counterclaim is filed, ask the court early to order the rent paid in.
  • Keep proof of when you learned of the condition, since the tenant must show your knowledge.

How DoorKeeping fits in Oregon

The tenant has to prove you knew about the condition, so the date you first heard matters. DoorKeeping keeps tenant messages with their received dates in the unit thread and the repair work order beside them. Rent and payments stay in your own bank accounts. General information, not legal advice; confirm the current ORS chapter 90 and local rules.
