Michigan rent escrow: rent can be suspended and paid to an escrow account run by the housing agency
Michigan has no simple right for a tenant to keep rent for a broken heater. The Housing Law of Michigan suspends rent and sends it to an escrow account held by the enforcing agency when a unit loses its certificate of compliance, and a court can let a complaining occupant fix a violation and deduct the cost. A tenant who withholds rent outside those paths still risks an eviction case.
When does Michigan law suspend a tenant's rent?
MCL 125.530(3) suspends the duty to pay rent during any period when the premises have not been issued a certificate of compliance, or when a certificate once issued has been suspended. The suspended rent is paid into an escrow account established by the enforcing officer or agency. It applies where the Housing Law applies, so check whether your city enforces it and requires a certificate.
- It does not apply until you have had a reasonable time after notice of violations to apply for a temporary certificate.
- It does not apply where you show that the hazardous conditions were caused by the occupants.
- Once the certificate is reinstated, rent is due again under the lease.
Who holds the money and where does it go?
The enforcing agency holds it. Under subsection (4), the escrowed rent is paid out to you or to another party authorized to make repairs, to cover the cost of correcting the violations. If the occupant ends the tenancy before repairs are undertaken, the agency returns the unspent part attributable to the unexpired rental period. This is different from a deposit with a court clerk: the agency, not DoorKeeping or you, controls the account.
What if the tenant withholds but does not pay into escrow?
Subsection (5) answers it. When the certificate is suspended or never issued and the withheld rent is not paid into the escrow account, you may still sue for rent and for possession, subject to whatever defenses the tenant has under the lease or contract. In other words, the statute protects a tenant who uses the escrow route, not one who keeps the money.
Example a made-up Lansing landlord has a certificate suspended on May 1 after an inspection finds no working furnace. The tenant pays $950 to the agency's escrow account instead of the landlord. Under 600.5720(1)(g) that payment is a ground for refusing a judgment for possession for nonpayment.
What defenses does MCL 600.5720 give a tenant?
Section 600.5720(1) bars a judgment for possession if the tenant proves certain facts. The ones that matter for withholding are subdivision (f), that the landlord committed a breach of the lease that excuses payment of rent when possession is claimed for nonpayment, and subdivision (g), that the rent was paid into escrow under section 125.530, paid under a court order under section 125.534(5), or paid to a receiver under section 125.535. The same section also bars possession for retaliatory terminations, with a presumption that arises when the tenant took official action within 90 days before the case.
Can a Michigan court let a tenant repair and deduct?
Yes, but only a court. Under MCL 125.534(5), if the occupant is not the cause of an unsafe or unsanitary condition and is the complainant, the court may authorize the occupant to correct the violation and deduct the cost from the rent on terms the court finds just. If the court finds the occupant caused the problem, it may let you correct it and charge the occupant or the deposit.
How DoorKeeping fits in Michigan
Housing inspections and escrow orders come with dates and letters. DoorKeeping lets you save an inspection notice and the follow-up repair work order in the same unit thread, so when a tenant says rent was suspended you can see which date the certificate changed. Rent and payments stay in your own bank accounts. This is general information, not legal advice; confirm your city's rules and the current statute.

Questions
- Can a Michigan tenant just stop paying rent for repairs?
- The sections read here do not give a general right to do that. They suspend rent into an agency escrow account when a certificate of compliance is withheld or suspended, and a court can authorize repair and deduct.
- Who holds escrowed rent in Michigan?
- The enforcing agency under MCL 125.530(4), which pays it to the landlord or another authorized party to cover repair costs.
- Does paying into escrow help a tenant in an eviction case?
- Yes. MCL 600.5720(1)(g) bars a possession judgment for nonpayment when the rent was paid into escrow under 125.530, under a 125.534(5) order or to a receiver.
