Maryland rent escrow: a tenant pays rent into court until serious defects are fixed

Maryland Real Property section 8-211 lets a tenant bring a rent escrow action and pay rent into court when a serious, dangerous defect goes unrepaired after notice. The statute is narrow: it covers threats to life, health and safety, not cosmetic problems, and a repair period over 30 days is presumed unreasonable.

Which defects does Maryland rent escrow cover?

Section 8-211 targets serious and dangerous conditions, such as lack of heat, light, electricity or running water (unless the tenant's own nonpayment caused it), no adequate sewage disposal, rodent infestation in two or more units, a structural defect that threatens physical safety, or any condition that is a health or fire hazard. It says plainly that it does not reach minor defects or nondangerous housing code violations.

  • Presumed not covered when they pose no serious threat: faded paint, worn carpet, small wall or ceiling cracks, missing floor tile.
  • The absence of air conditioning is on the presumed-not-covered list.
  • The statute applies to publicly or privately owned single and multiple units, but not farm tenancies.

What notice starts the clock?

The tenant must notify you, and the statute accepts three forms: a written communication by certified mail listing the defects, your actual notice of them, or a written violation or condemnation notice from a government agency. After notice you get a reasonable time to repair. The court decides what is reasonable based on severity and danger, and a period longer than 30 days from receipt is presumed unreasonable.

What can the tenant do if you do not repair?

Two things, alone or together. The tenant can bring a rent escrow action and pay rent into court, or refuse to pay and raise the defects as an affirmative defense to a rent distress action or a complaint for rent or possession. Several tenants in the same building may join as plaintiffs. The court can order separate trials to avoid delay.

There is a rebuttable presumption that the tenant is entitled to have rent abatement decided, and that a court-ordered escrow covers only rent due and unpaid after the order. Either side can ask the court to adjust the amount paid in at any time.

What conditions limit the tenant's relief?

ConditionWhat section 8-211 says
Proper noticeNotice and a chance to correct must come first
Rent paymentThe tenant pays the lease rent into court unless the court modifies the amount
Prior judgmentsNot available if the court entered three judgments of possession for unpaid rent against a monthly tenant in the prior 12 months
Tenant faultA sufficient defense if the tenant, family, guests or agents caused the defect
AccessA sufficient defense if you were denied reasonable entry to make repairs

Example a made-up Baltimore landlord is told by certified mail that a bathroom ceiling has partly collapsed. On day 12 the landlord asks for access and the tenant refuses twice. Under subsection (l) the refusal of reasonable and appropriate entry is a sufficient defense to the tenant's claim.

What can the court order?

After findings of fact, the court may end the lease, dismiss the escrow action, abate the rent by a fair amount, or order repairs. Once escrow is in place, the court must, after a hearing, release funds to you once repairs are made, and may use escrowed money to pay for repairs or appoint a special administrator to do them. If no good-faith repair effort occurs within 6 months, the court may release the money to the tenant after a hearing. A tenant who wins relief can recover attorney's fees and costs, but a bad-faith complaint can make the tenant pay yours.
