Delaware rent withholding: two-thirds of the daily rent when heat or water stays off for 48 hours

Delaware lets a tenant keep two-thirds of the per diem rent while hot water, heat, water or electricity is not supplied, after the failure has lasted 48 hours following notice. A separate rule allows a tenant to fix a defect and deduct up to the lesser of $400 or half a month's rent. A tenant who withholds wrongly can owe you the money, or double if the court finds bad faith.

When can a Delaware tenant withhold rent?

Section 5308(a) covers a substantial failure to provide hot water, heat, water or electricity, or a failure to remedy a condition that materially deprives the tenant of a substantial part of the bargain in violation of the lease, the Code or a housing code. It must continue 48 hours or more after the tenant gives actual or written notice. The tenant may then end the lease on written notice, or keep two-thirds of the per diem rent for the period the service is not supplied.

You can avoid the per diem liability by showing impossibility of performance, for example a utility outage you could not fix. Under subsection (c), withholding does not stop the tenant from recovering larger damages later.

What if the tenant stays and the outage continues?

Subsection (b) adds options for a tenant who gave notice and remains while you still fail to provide water, hot water, heat and electricity as the local housing code requires. The tenant may end the lease, find equivalent substitute housing while the rent abates (with you liable for extra costs up to half the abated rent, unless you show impossibility), or withhold two-thirds of the per diem rent.

Example a made-up Wilmington landlord charges $1,500 a month in a 30-day month, or $50 a day. After a 5-day heat outage past the notice period, a tenant who withholds keeps two-thirds of $50 a day, which is about $33.33 a day, or about $166.67 for the 5 days.

How does Delaware repair-and-deduct work?

Section 5307 applies to a landlord who fails to repair, maintain or keep the unit sanitary as the law or lease requires. The tenant sends written notice. If you do not fix the problem within 30 days of receipt, or do not start reasonable corrective measures, such as getting an estimate, within 10 days, the tenant may have the work done professionally and deduct a reasonable sum. The deduction cannot exceed $400 or half of one month's rent, whichever is less, and the tenant must give you receipts covering at least the amount deducted.

  • No repair at your expense when the tenant or a guest caused the problem through want of due care.
  • A tenant already delinquent in rent cannot use section 5307.
  • The tenant is liable for damage caused by the tenant or anyone the tenant authorized to make repairs.

What can the landlord recover from wrongful withholding?

If you file for summary possession and the court finds the tenant wrongfully withheld or deducted rent under section 5308, you can get either possession or an amount equal to the wrongly withheld money. If the tenant acted in bad faith, the amount is double. The judgment is payable within 10 days, and if it is not paid the damages, with costs, become a judgment for the amount withheld plus summary possession without further notice.

What should a Delaware landlord do within 48 hours?

Treat any no-heat or no-water message as a clock. Note the time of the report, call the utility or contractor the same day, and confirm in writing what you did and when service returned. If the failure is outside your control, keep the proof, because impossibility of performance is the defense to the per diem rule. Do not wait for a written letter if the tenant has already reported it by phone or text: actual notice also counts.

How DoorKeeping fits in Delaware

A 48-hour rule favors owners who log fast. DoorKeeping files a tenant's emergency message in the unit thread with its time, and you can send a plumber or HVAC job by link while the hours are running. The record of when service came back is the same thread. Rent and payments stay in your own bank accounts. General information, not legal advice; confirm the current Code and your lease.
