When a tenant dies in Oklahoma: ask every tenant for a contact person, then follow the certified-letter steps
Oklahoma Statutes title 41, section 130.1 lets you ask each tenant for the name of a person to contact if they die. When a sole occupant dies, you may remove and store the property, hand it to that person or anyone lawfully entitled, and discard it only after a certified letter and 30 days with no claim.
What can you ask a tenant for in advance?
On your written request, a tenant must give you the name, address and phone number of a person to contact if the tenant dies. The tenant must also sign a statement allowing you, after a death, to let that person into the premises at a reasonable time with you or your agent present, to let that person remove the tenant's property, and to refund the security deposit, less lawful deductions, to that person.
A tenant can give this information without being asked. If a tenant is given your written request and knowingly fails to provide it, you have no responsibility after the death for removal, storage, disappearance, damage or disposition of the property in the unit.
What can you do when a sole occupant dies?
Unless you and the tenant agreed in writing to a different procedure, subsection C applies when the tenant who died was the sole occupant of the rental dwelling.
- You may remove and store all property found in the unit.
- You must turn the property over to the person the tenant designated, or to anyone else lawfully entitled to it, if they ask before it is discarded.
- You must refund the security deposit, less lawful deductions including the cost of removing and storing the property, to the designated person or another person lawfully entitled to it.
- Anyone who removes property must sign an inventory when they take it and give the signed inventory to you.
When can you discard the property?
Only if you have mailed a written request by certified mail, return receipt requested, to the designated person asking them to remove the property, the person has not removed it by the thirtieth day after the postmark date, and no one has contacted you claiming it before you discard it.
Example a made-up tenant dies in early September. You mail the certified letter on September 3. The thirtieth day after the postmark is October 3. If nobody has contacted you or removed the property by then, you may discard what you stored.
If a landlord who has been given a copy of the section knowingly violates subsection C, the landlord is liable to the estate for actual damages.
Does the lease end, and what rent is owed?
Section 41-130.1 is about the property and the deposit. It does not say that the lease ends on death, and it does not say what rent the estate owes. Check your lease and the other sections of the Oklahoma Residential Landlord and Tenant Act, and write to the contact person or personal representative about the date you need the unit back.
How long do you have to refund the deposit?
Section 41-115 says that after the tenancy ends you may apply the deposit to accrued rent and damages, with a written itemization delivered by return-receipt mail, and return the balance without interest within 45 days after the termination of the tenancy, delivery of possession and written demand by the tenant. If the tenant makes no written demand within six months after termination, the deposit reverts to you.
Section 41-130.1 adds that the refund goes to the designated person or another person lawfully entitled, and that your deductions can include the cost of removing and storing the property. Treat a written demand from the designated person or the personal representative as the demand.
Example a made-up $900 deposit, with $120 of storage cost and $200 of unpaid rent. The itemized letter shows $320 withheld, and $580 goes to the designated contact within 45 days of the demand.
How DoorKeeping handles it
DoorKeeping keeps the death-contact name and phone you collect with each Oklahoma lease, so it is on file the day you need it. Your certified-letter date and the 30-day and 45-day counts are kept with the property record, and money or legal steps wait for your approval. This is general information, not legal advice. Check the current statute, your lease and your own situation before you act.
