My landlord insurance was non-renewed: what do I do?

Start shopping the day the notice arrives, because the old policy ends on the date in the notice and a gap in cover can break your mortgage terms and leave a loss unpaid. Ask the insurer for the reason, ask an independent agent to quote other companies, and if the standard market says no, look at your state's FAIR Plan or the surplus lines market. States set the notice period and your rights, so read your state insurance department's guidance.

Read the notice before anything else

A non-renewal is different from a cancellation. A non-renewal means the insurer will not offer a new term when the current one ends. A cancellation ends the policy during its term and is usually allowed only for reasons set by state law, such as non-payment or a material misrepresentation. State laws set how many days of written notice an insurer must give and what the notice must say, and the periods differ, so check your own state.

  1. Find the effective date. The policy normally stays in force until then.
  2. Find the stated reason, if one is given. Common reasons include roof age, claims history, an unrepaired condition, a vacant building or the company leaving a market.
  3. Check whether the notice also went to your mortgage lender. Many lenders get a copy and may buy their own coverage for you, called lender-placed insurance, at a much higher cost.
  4. Write down the date you received it. Keep the envelope or email.

Your state insurance department can explain the notice rules and take complaints. The NAIC lists each department.

What to do in the first week

  • Call your agent and ask for the specific reason. If it is a condition, such as a worn roof or a missing handrail, ask what proof of repair would change the answer.
  • Ask an independent agent, who can quote several companies, to shop the property. Give each the same details so the quotes compare.
  • Fix what is fixable and photograph it with dates: a roof repair, updated wiring, a leaking pipe, damaged steps.
  • Check whether a policy form with fewer perils is available at your price. A narrower form is better than a gap, but note what it leaves out.
  • Do not cancel the old policy until the new one is bound in writing and your lender has the new proof.

If you hold several properties with one company, ask whether the non-renewal applies to every one or only this building.

When the standard market says no

Two backstops exist in many states. Neither is a first choice, because they can cost more or cover less, but both can keep a property insured.

OptionWhat it isWatch for
State FAIR PlanA pooled insurance plan that many states run for property owners who cannot find cover in the standard market. Not every state has one and the rules differLimits on the building value, narrower perils, a separate policy for liability, and different rules for rental use
Surplus lines (excess and surplus market)Insurers that are not licensed in the usual way and write unusual risks through a licensed surplus lines brokerHigher cost, state guaranty funds may not protect you if the insurer fails, and the broker must disclose it
A different policy formSome companies write only a narrower dwelling fire form for rentalsFewer covered causes of loss; read the exclusions

Keep records of every insurer you contact and every answer. If you appeal a decision or file a complaint with your state insurance department, a dated list of calls, emails and quotes is the first thing they ask for, and it shows you acted promptly.

A FAIR Plan policy often covers property damage only. You may need a separate liability policy, so ask what each one pays before you rely on it.

This is general information, not insurance or legal advice. Your policy wording, your state and your licensed agent or attorney decide what applies to you.

Your mortgage lender needs proof of cover

Most mortgages require continuous property insurance with the lender named on the policy. If your insurance lapses, the lender can place its own insurance on your property and bill you, and that coverage often protects the lender's interest and not yours. Send the new policy's declarations page to your lender the same day it is bound.

If an LLC owns the property, the LLC should be the named insured, and the lender's requirements may mention the entity. Match the names on the policy to the deed and the loan.

How to avoid the next non-renewal

  • Keep roofs, wiring, plumbing and water heaters in good shape and keep the dates and invoices.
  • File only claims worth filing. Small claims can add up on your record, so weigh a small repair against the effect on renewal. Your agent can advise.
  • Respond fast to any inspection report the insurer sends and show the fix.
  • Start shopping 60 to 90 days before renewal, not after a notice.

How DoorKeeping handles it

Keep the notice, each policy's declarations page, repair invoices and photos as documents under the property so an agent can see what you fixed and when. Work orders with dates show you handled a condition quickly. DoorKeeping does not sell insurance or decide coverage.

Questions

What is the difference between non-renewal and cancellation?
A non-renewal means the insurer will not offer a new term when the current one ends. A cancellation ends cover during the term and is usually limited by state law to certain reasons.
What is a FAIR Plan?
It is a state-sponsored pool that offers property insurance to owners who cannot get it in the standard market. Availability and terms differ by state, so check your state insurance department.
Can my mortgage lender buy insurance for me?
If your insurance lapses, many lenders can place coverage and add the cost to your loan. It is often more expensive and protects the lender first, so avoid a gap.
