Hawaii rent receipt law: a written receipt at the time of payment, and a canceled check counts

HRS 521-43(e) requires a Hawaii landlord to give the tenant a written receipt for rent paid, at the time of payment. Canceled checks satisfy the requirement. If rent is paid by check, the landlord must furnish a receipt for it when the tenant asks.

What does HRS 521-43(e) require?

The landlord shall furnish to the tenant a written receipt for rents paid at the time of payment. Unlike many states, Hawaii does not limit the duty to cash: the default is a receipt for rent paid.

How do checks fit in?

Canceled checks also constitute and fulfill the requirement of a written receipt. So a tenant who pays by check already holds a record once the check clears. If rent is paid by check, the landlord shall furnish a receipt for it provided the tenant requests one.

Example a made-up tenant pays $2,100 by check on the 1st. The cleared check, which the tenant can retrieve, counts as the receipt. If the tenant asks you for a separate receipt, you must give one.

Why does the same section matter for managers and agents?

Subsection (a) requires the landlord to disclose in writing, at or before the start of the tenancy, the name and address of each person authorized to manage the premises and of each owner or person authorized to act for the owner for service of process and for receiving and receipting for rents, notices and demands.

Under subsection (b), a person who fails to disclose becomes an agent of each person who is a landlord for service of process and for receiving and receipting for rents, notices and demands. In plain terms, tenants should know who takes the rent and gives the receipt.

What else must the landlord furnish?

Subsection (d) says that for a written rental agreement, the landlord shall furnish a copy of the lease or rental agreement to the tenant. Keep proof that you did, such as a signed acknowledgment, next to your receipts.

What does the subsection leave out?

It lists no required contents, no retention period and no penalty of its own. Write a receipt with the date, amount, unit, period and who took it, as in what a rent receipt should include. The wider question is in do landlords have to give rent receipts, and how long to keep rental records covers retention.

What should the receipt show?

The subsection does not list contents, so use the usual set: the date, the amount, how it was paid, the unit and the rent period, and the name of the person who took it. A receipt that carries those items answers nearly any later question about whether a month was paid. Keep the same format every month so that a gap in your records is easy to spot, and store each tenant's receipts in one place.

A simple receipt routine for Hawaii landlords

In Hawaii the default runs the other way from most states: a receipt is the rule, and the exceptions are for checks. Landlords who accept cash should carry a receipt book, and landlords who take only checks should know that a cleared check already counts. To avoid friction, tell tenants in the lease how they will receive proof of payment, and answer a request for a receipt on a check promptly. If a manager or agent takes the rent, name that person in the written disclosure the statute requires, so that the tenant knows who may receive and receipt for rent. Keep a copy of every receipt with the tenancy file.

How DoorKeeping fits in Hawaii

Tenants pay your own bank by bank transfer or Zelle, and DoorKeeping matches each deposit to the tenant with its date and amount. Your bank's own record of the transfer sits alongside it, which helps if a tenant asks for proof. This is general information, not legal advice. Check the current text of the law and your lease before you act.
