Delaware military lease termination: a tenant who enters active duty, 30 days from the next month

Under 25 Del. C. 5314(b)(5), a Delaware tenant who, after signing a rental agreement, enters the military service of the United States on active duty can end the tenancy with 30 days' written notice. The 30 days begin on the first day of the month after the day the landlord actually gets the notice.

What does 25 Del. C. 5314 say about military service?

Section 5314 is titled the tenant's right to early termination. Subsection (a) says that when either party rightfully elects to terminate, the duties of each party under the rental agreement cease and all parties discharge any remaining obligations as soon as practicable. Subsection (b) lists the situations that qualify, on 30 days' written notice, and item (5) is the military one: a tenant who, after the execution of the rental agreement, enters the military service of the United States on active duty.

The same list covers other tenants too, such as a change of job location of more than 30 miles with the tenant's present employer, serious illness, acceptance into senior or subsidized housing, domestic abuse victims, and the surviving spouse or personal representative of a deceased tenant. Only item (5) is about military service.

Who and what triggers it?

The trigger is entering active duty after the lease was signed. The text does not mention orders, a commanding officer's letter, a distance test or a deployment length. It also does not name National Guard state service. That is a narrower trigger than some states, but it has no mileage or duration test attached.

Because the statute does not say what proof to ask for, a copy of the enlistment or active duty orders is a reasonable request that keeps your file complete. A tenant already in the service when the lease is signed who later gets orders is a case for the federal SCRA lease rule and your lease, since item (5) speaks of entering service after signing.

How is the 30-day clock counted?

The notice must be in writing. The 30-day period begins on the first day of the month following the day of actual notice. That is different from counting 30 days from the day you receive it, and it usually adds a few days.

Example a made-up tenant in Dover gives written notice on September 12 after entering active duty. The 30 days start on October 1, so the tenancy ends on October 31. The owner bills rent through October 31 under the lease.

The section does not say anything about early termination fees or the security deposit. Subsection (a) says the parties discharge remaining obligations as soon as practicable, so settle the final rent, any damage charges and the deposit return promptly after move-out, and write it down.

What belongs in the file?

  • The written notice, with the date you received it.
  • A copy of the orders or enlistment papers if the tenant offers them.
  • A note of the first day of the following month and the end date.
  • The move-out inspection and the final accounting.

Does it matter if the lease is month-to-month or fixed?

Section 5314(b) applies to "the tenancy," and the list does not separate fixed terms from periodic ones. A month-to-month Delaware tenant already needs notice under the general rules, so the military item matters most for a fixed-term lease with months left. Read the lease's notice clause alongside the statute and note which one the tenant used.

Also remember that item (5) sits beside other qualifying reasons. If a tenant gives a military reason and another reason from the list applies too, the same 30 day structure covers either.

How DoorKeeping fits in Delaware

DoorKeeping keeps the notice and supporting papers with the lease and ledger, and the final rent and any deposit return can wait in your approvals queue for a tap. This is general information, not legal advice. Check the current statute and your lease, and ask your own advisor about a specific tenant.
