The automatic renewal clause in a lease: how it works

An automatic renewal clause says the lease renews on its own for another term unless one side gives notice before a set date. It is different from a month-to-month rollover, where the tenancy simply continues by the month after the term ends. Some states regulate or limit automatic renewals, so write the clause plainly, state the notice date, and remind the tenant before it passes.

Three things that happen when a lease ends

People mix these up, and the difference decides what rent and notice rules apply.

What happensHow it works
Lease endsThe tenant must move out on the end date unless you both agree to something else. If they stay, see holdover.
Month-to-month rolloverThe tenant stays and the tenancy continues month by month, usually at the same rent, ended by notice from either side.
Automatic renewalThe lease renews for a new fixed term (often the same length) unless someone gives notice before the deadline in the lease.

Your lease and your state decide which one applies. Some states turn a fixed term into a month-to-month tenancy by law when the tenant stays; others leave it to the lease. The guide to month to month versus a one year lease helps you pick the structure first.

The notice deadline is the heart of the clause

An automatic renewal clause is only fair if both sides can see the deadline. Write it as a calendar rule, such as "at least 60 days before the lease ends," and repeat the actual date in an email. Without a clear date, a tenant who thought they were free to leave can be bound to another year, and a landlord can be stuck with a tenant they meant to replace.

Example a made-up one year lease ends on August 31 and says it renews for one year unless either side gives 60 days' written notice. The last day to give notice is July 2. If neither side does, the lease renews to the next August 31. Reminding the tenant on June 1 and again on June 25 leaves no one surprised.

States and cities can limit it

Rules differ. Florida, for example, has section 83.575, which covers terminating a tenancy with a specific duration and a notice of nonrenewal; our guide to Florida's lease end notice explains it. Some places require that the renewal term and any rent change be disclosed, require a reminder, or cap what can happen at renewal. Rent increase rules and caps apply on top of any renewal clause.

Because these rules change from state to state, read your own statute and your city's rules before you use a template. A clause that a statute does not allow may simply not be enforced.

What about the rent at renewal

A renewal clause that locks in the same rent for another term means you cannot raise rent until the end of that term. If you want the option to change the rent, say how: for example, that you will send a new rent amount by the notice date. Then follow your state's rent increase notice rule. See rent increase notice requirements.

Writing the clause so it holds up

  1. Use plain language, in the same type size as the rest of the lease.
  2. State the term of the renewal and whether the rent stays the same.
  3. State the notice period in days and how notice must be given (in writing, by email, by mail).
  4. State what happens if notice is not given in time.
  5. Leave a place for both sides to initial the clause, if your state or lease form asks for it.

Then do what the clause says. If you want the tenant to leave, send notice on time. If you intend to renew, say so early and keep the signed record.

How DoorKeeping handles it

DoorKeeping reads the end date and notice period from each lease, so you can ask Claude or ChatGPT, "Which leases pass their nonrenewal notice date in the next 45 days?" It drafts a renewal offer or a reminder from the lease, and nothing goes to a tenant until you approve it. Renewal offers are e-signed like leases.

DoorKeeping does not decide whether a clause is allowed in your state and gives no legal advice. It keeps the dates and the signed copy together.

Questions

What is an automatic renewal clause in a lease?
A term saying the lease renews for a new fixed term on its own unless one side gives notice before a stated date.
Is it the same as month to month?
No. A month-to-month tenancy continues by the month and can be ended with notice. An automatic renewal starts another fixed term, often a full year.
Can a state limit automatic renewals?
Yes, some states and cities regulate them or require disclosures or reminders. Read your own law before using one.
