What happens when rent is due on a weekend or holiday?

In some states the law moves a payment due on a weekend or public holiday to the next business day. New York does this for contract payments in General Construction Law 25, so rent due on a Sunday can be paid Monday without being late. Even where no statute applies, write the rule into your lease and count late fees from the next business day.

New York: the next business day counts

New York has one of the clearest rules. General Construction Law 25 says that when a contract requires a payment on a Saturday, Sunday or public holiday, or a period for payment ends on one, the payment may be made on the next business day. A lease is a contract, so rent due on the 1st that falls on a Sunday may be paid on Monday the 2nd.

The same section says the extra days are generally not counted when computing interest, unless the contract says otherwise. In practice: do not charge a late fee for a payment made on the next business day, and do not start counting a grace period until the real due date has passed.

Other states and notice periods

Not every state has a general rule for contract payments, and the details vary. Weekends and holidays also matter for the notices that follow late rent, where the count is set by statute.

Florida is an example. Its three-day notice for unpaid rent, in Florida Statutes 83.56(3), runs for three days "excluding Saturday, Sunday, and legal holidays," and the statute says legal holidays means court-observed holidays only. A notice delivered on a Friday therefore does not expire on Monday.

This table illustrates the Florida counting rule only. Every state counts differently, and court holidays change from year to year. Check your state statute and court calendar, or ask an attorney, before serving a notice.

Why weekends also slow the money down

Even a tenant who pays on time can look late because banks do not move money on weekends. Nacha, which runs the ACH network, says on its ACH overview that settlement happens only while the Federal Reserve settlement service is open, which excludes weekends and federal holidays. A transfer the tenant starts on Saturday morning usually settles on the next business day at the earliest.

Example a made-up building has rent due on the 1st and a late fee after the 5th. The 1st falls on a Saturday. A tenant starts a bank transfer that Saturday, it settles on Monday the 3rd, and it shows in the owner's account that day. The payment was made on time, and it is within the grace period either way, so no late fee applies.

What to write in your lease

A short clause avoids most arguments. Many owners use wording like this, adapted to their state:

"If the rent due date falls on a Saturday, Sunday or legal holiday, rent is due on the next business day. Any grace period and late fee is counted from that day. A payment counts as made on the day the tenant starts the bank transfer, if it later arrives in full."

  • Name the methods you accept and the account they go to.
  • Say which day counts as payment: when the tenant sends it, or when it arrives.
  • Match the grace period to your state's rules; see rent grace periods by state.
  • Apply the same rule to every tenant, every month.

Holidays that often fall near the 1st

New Year's Day is always on the 1st, and Labor Day (first Monday of September) can fall on the 1st. When a federal holiday falls on or next to the due date, send a short reminder a few days ahead that names the real last day to pay. It costs nothing and removes the most common reason for a disputed late fee.

How DoorKeeping handles it

In DoorKeeping, rent goes straight to your own bank; DoorKeeping never holds it. You can ask your AI app which tenants have not paid and what each owes, and any late fee or notice waits for your one-tap approval before anything goes out, so a weekend due date never produces a fee you did not mean to charge.

Questions

If rent is due on Sunday, is Monday late?
In New York, no: General Construction Law 25 lets a contract payment due on a weekend or holiday be made the next business day. Elsewhere it depends on your state and your lease, so write the rule into the lease.
Do weekends count in a three-day pay or quit notice?
It depends on the state. Florida excludes Saturdays, Sundays and court-observed holidays from its three-day notice. Check your own state statute before serving one.
Can I charge a late fee if the payment arrived Monday after a Sunday due date?
Doing so invites a dispute, and in New York the payment is not late. The safest practice is to count any grace period and late fee from the next business day.
