Breaking a lease in Ohio: one statutory exit, the exemption for small landlords and what Chapter 5321 leaves to the lease

Ohio's Landlords and Tenants chapter has one early exit for tenants: R.C. 5321.07(B)(3), after a landlord fails to fix a health, safety or code problem within a reasonable time or 30 days, whichever is sooner. It exempts landlords with three or fewer units who give written notice of that fact. I found no state military, domestic violence or mitigation section in Chapter 5321, so the lease and the federal SCRA carry those topics.

What is the Ohio tenant's statutory exit?

Under R.C. 5321.07(A), when a landlord fails to meet a duty under 5321.04 or a lease obligation, or a government agency finds code violations that could materially affect an occupant's health and safety, the tenant may give written notice specifying the problems. The notice goes to the person or place where rent is normally paid.

If you do not remedy within "a reasonable time considering the severity of the condition and the time necessary to remedy it, or within thirty days, whichever is sooner," and the tenant is current in rent, the tenant may do one of three things under (B): deposit rent with the clerk of court, apply to the court for an order, or terminate the rental agreement. The rent-current condition matters: a tenant who is behind loses the route.

Example a made-up Cleveland tenant, current on $1,000 rent, sends written notice of a failed furnace on January 5. If the problem is still unfixed on the thirtieth day, February 4, at the latest, the tenant may terminate, or sooner if a court finds a shorter reasonable time. Fixing the furnace in a few days ends the route.

Which landlords and tenants are outside the section?

  • Subsection (C): a landlord who is party to rental agreements covering three or fewer dwelling units and who gives notice of that fact in a written rental agreement, or in writing at initial occupancy for an oral tenancy.
  • Subsection (D): a dwelling unit occupied by a student tenant.

If you own three or fewer units, put the notice sentence in your lease. Without it, the exemption is not yours to claim.

Is there a special rule for college students?

R.C. 5321.031 limits the other direction: a college or university may terminate a student tenant's rental agreement and require the student to vacate only after a hearing that determined the student violated the rental agreement or the college's code of conduct. The hearing must be preceded by written notice, and the agreement must specify the conditions and procedures. It is relevant if you rent through a school.

What about military, domestic violence and re-renting?

Searching Chapter 5321, I did not find a state service member release, a domestic violence release, a mitigation duty or a rule on early termination fees. A shelter exemption in the definitions is the only mention of domestic violence victims. Three practical rules follow.

  1. For military tenants, apply the federal SCRA (50 U.S.C. 3955): termination on notice with orders, and no early termination charge.
  2. For any release you grant, put it in a short signed agreement stating the end date and what rent is owed.
  3. For fees, write the amount and trigger in the lease and keep it tied to a real cost such as re-letting.

Keep records of when you listed, showed and re-rented the unit, and ask your own attorney about case law on mitigation.

How DoorKeeping helps in Ohio

DoorKeeping keeps each lease's dates, notices and ledger in one place. When a tenant gives notice, you can ask Claude or ChatGPT to total what is owed through the end date and draft your reply, and nothing goes to the tenant until you approve it with one tap. DoorKeeping never holds your money and sends a payment only when you approve it. This is general information, not legal advice: check the current statute and your own lease.
