Breaking a lease in Nevada: three statutory ways out and one gap you should plan for
Nevada's landlord-tenant chapter lets a tenant leave early in two named situations: when a household member is a victim of domestic violence, harassment, sexual assault or stalking (NRS 118A.345), and when the landlord fails to keep the unit habitable (NRS 118A.355). It also sets a presumption of abandonment in NRS 118A.450. What it does not contain is a re-renting formula, so your lease has to carry that.
How does the victim release in NRS 118A.345 work?
A tenant or cotenant may terminate by written notice effective "at the end of the current rental period or 30 days after the notice is provided to the landlord, whichever occurs sooner." The notice must describe the reason and come with proof. For domestic violence, that is a protection order, a law enforcement report, or an affidavit signed by a qualified third party in the form of NRS 118A.347. For harassment, sexual assault or stalking, it is a law enforcement report or a temporary or extended order under NRS 200.378 or 200.591.
The events must have occurred within the 90 days before the notice (subsection 4). The tenant owes rent through the termination date and other outstanding obligations; you may keep prepaid rent for that rental period, and the deposit "must not be withheld for the early termination" (subsection 5). The adverse party may be civilly liable for your economic losses (subsection 6).
Example a made-up Las Vegas tenant pays $1,350 on the 1st and sends a valid notice with a protection order on March 10. The end of the current rental period is March 31, which comes before April 9 (30 days later), so the lease ends March 31. The tenant owes March rent only, and you cannot charge a termination fee.
When can a tenant leave over the condition of the unit?
NRS 118A.355 requires the tenant to deliver a written notice that lists each failure to keep the unit habitable and asks for a fix. If the problem can be fixed and you fix it, or use best efforts, within 14 days after receipt, the tenant cannot proceed. If you fail to remedy a material failure or make a reasonable effort in that time, the tenant may terminate the rental agreement immediately, recover actual damages, ask the court for relief, or withhold rent without late fees until you remedy or attempt in good faith to remedy.
The tenant has no rights under the section for conditions the tenant, the household or guests caused (subsection 2 and, in NRS 118A.350, subsection 5). Document your repair dates: the 14-day clock is the fact that matters.
How do you treat a tenant who disappears?
NRS 118A.450 says that if you have notice of abandonment, you may dispose of personal property as NRS 118A.460 provides and recover possession under NRS 118A.480. Without notice, abandonment is presumed if the tenant is absent for a period equal to one-half the time for periodic rental payments, unless the rent is current or the tenant told you in writing of an intended absence. For monthly rent, that is about half a month of absence.
NRS 118A.460 lets you dispose of abandoned property, with safe storage for 30 days and the other steps it lists. Follow them before clearing the unit.
What does Nevada's chapter not say?
Searching Chapter 118A, I found no service member release, no early termination fee cap and no duty to re-rent. Military tenants have the federal SCRA, 50 U.S.C. 3955. For everyone else, the rent owed after an early exit depends on your lease and general contract law, so write the exit terms in the lease: the notice period, any fee, and how you will credit rent from a new tenant.
- State the fee amount and when it applies.
- Say how you will credit reletting income.
- Keep a record of listing dates and showings if the tenant leaves.
How DoorKeeping helps in Nevada
DoorKeeping keeps each lease's dates, notices and ledger in one place. When a tenant gives notice, you can ask Claude or ChatGPT to total what is owed through the end date and draft your reply, and nothing goes to the tenant until you approve it with one tap. DoorKeeping never holds your money and sends a payment only when you approve it. This is general information, not legal advice: check the current statute and your own lease.
